File a commercial agency infringement complaint

Required documents

For the owner/complainant:

• A valid commercial agency registration certificate issued by the Ministry of Economy (MOE)
• A written description (and necessary attachments) of the complaint, which contains:
  • infringement information
  • subject of the complaint
  • images of the products

Additional for legal representatives or agents:

• Valid legal power of attorney and copy of the trade licence

Prerequisites

• This service is available to those who already have their agency registration certificate approved on the IP Gateway portal
• The complaint submitted must be within the IP department’s jurisdiction
• The complainee is licensed in Dubai, with the exception of free zones
• The commercial agency owner can raise complaints about one or multiple retailers in a single case

Service fees 

• AED2,500 case study fee
• AED1,000 inspection fees on defendant sites – up to three sites
• AED300 per additional location
• AED2,500 inspection fee per warehouse

Steps

1. Login to your IP Gateway account and select the button for Agency concerns
2. Choose 'Open File' and fill in required details; you can add more retailers to the same case
3. Make the mandatory case study payment to save and complete your request
4. The IP department reviews the case and if approved, the agency owner has to pay the inspection fees for establishments complained against
5. The IP department will then conduct inspections and upload reports per site
